Design and Slogan Submission Legal Terms and Conditions

By selecting "I Agree" below and in consideration of De-vote.com evaluating your Design or Slogan (hereinafter the "Design or Slogan") for its possible use on clothing and promotional items (the "Items"), you agree to the following terms and conditions ("Design Submission Terms and Conditions"):

If your Design or Slogan is selected for use by De-vote.com, you acknowledge that you assign to The Good Design Company Ltd. and its subsidiaries and affiliates (hereinafter collectively "De-vote.com") the entire right, title, and interest in and to the copyright in your or Slogan including the right to sue for past infringement and the right to further sublicense the Design, for its sole and exclusive use on and in connection with the Items. You also acknowledge that you waive all "moral" rights that you may have in and to your Design or Slogan.

If your Design or Slogan is selected, De-vote.com may use your Design or Slogan in any manner on or in connection with the Items, including but not limited to: reproducing the Design or Slogan on the Items, selling Items bearing the Design or Slogan, changing or reworking the Design or Slogan by making colour, size or word changes, making derivative works of the Design or Slogan, using the Design or Slogan on the De-vote.com website and on promotional material for De-vote.com, and registering the Design or Slogan with the Intellectual Property Department of the Hong Kong Special Administrative Region in the name of The Good Design Company Ltd. as the Claimant, and you as the Author. You agree to provide De-vote.com with minimal information as may be required in order to register the copyright in the Design or Slogan if De-vote.com so requests, at no cost. The Design or Slogan and any modifications or derivatives thereof may be modified without any additional approval being required of you, with the exception that you shall be shown such modifications and derivatives and shall have a right to withdraw use of your name as a credit. You hereby waive any and all attribution and integrity rights with regard to the Design whether arising under the law of the Hong Kong Special Administrative Region, or the law of any other country.

De-vote.com shall use reasonable efforts to ensure that the use of the Design or Slogan in the Items are accompanied by a reasonable credit to you (subject to your right to withdraw such credit as discussed above).

You may use or continue to use the Design or Slogan for any other purposes, except those described below.

If your Design or Slogan is selected, you may not use the Design or Slogan (or derivatives of the Design or Slogan) or allow others to use the Design or Slogan (or derivatives of the Design or Slogan) on any Items, as described above. In addition, by submitting your Design or Slogan, you may not reproduce, sell, or submit the Design or Slogan to others for any commercial purpose for ninety (90) days after the date of submission while the Design or Slogan is being evaluated by De-vote.com. Once the ninety (90) days have passed, if your Design is not chosen for print by De-vote.com, you are free to use the Design or Slogan for any commercial or non-commercial purpose. However if your Design or Slogan is used elsewhere, you must notify De-vote.com by email info@de-vote.com about where and when the Design or Slogan will be used, so that it can be removed from the De-vote.com website at that time. In addition, if the Design or Slogan is used or reproduced for commercial purposes elsewhere, you cannot use any pages on the De-vote.com website to promote the Design or Slogan or the company using the Design or Slogan.

You further agree not to use any pages on the De-vote.com website to promote the products and services of any company that operates in competition with De-vote.com. De-vote.com reserves the right to choose your design after the (90) days have passed, on the condition that the design has not been used for commercial purposes on any Items, as described above.

You acknowledge that the Design or Slogan you are assigning to De-vote.com is your own original work, has not been previously published, and does not contain any trademarks, logos, copyrighted material, or any other intellectual property belonging to any third party, or any material, which De-vote.com in its sole discretion, deems to be profane or offensive.

You acknowledge that De-vote.com reserves the right to decline to select a Design for consideration for any reason.

If your Design or Slogan is selected for use by De-vote.com.com, you will receive an award determined by De-vote.com that may change from time to time. De-vote.com.com reserves the right to change these rewards at any time, by posting them on the De-vote.com.com website, and changes will be effective upon posting. Rewards will be based on the terms in effect when your Design or Slogan is selected. You alone will be responsible for the reward of any tax or additional costs that arise as a result of receiving a reward from De-vote.com.com. Rewards will be sent within ninety (90) days after De-vote.com.com receives hi-resolution artwork deemed suitable for print. If the hi-resolution artwork is not deemed suitable for print as determined by De-vote.com.com, De-vote.com.com will notify you of the reason(s) for its determination by email and will make a good-faith effort to assist you in presenting a suitable hi-resolution format.

Participants, who in the opinion of De-vote.com.com, do not comply with these Design and Slogan Submission Legal Terms and Conditions, or for any other reason at De-vote.com.com's sole discretion, can at any time be excluded from consideration without notice.

If any part, term or provision of this Agreement shall be held illegal, unenforceable, or in conflict with any law of a federal, state or local government having jurisdiction over this Agreement, the validity of the remaining portions or provisions shall not be affected thereby.

The decisions of De-vote.com.com are final and binding.
